At Iperium, we’re committed to providing all our customers with reliable, high-performance services. To ensure a consistent and optimal experience across our network, this Fair Use Policy outlines the reasonable and responsible use of our services.
This policy is designed to prevent misuse and protect the integrity of our services for all users. By clearly defining what constitutes fair use, we aim to maintain the quality, speed, and reliability our customers expect—while ensuring equitable access for everyone.
At Iperium, we’re committed to delivering a high-quality, reliable service to all our partners. To ensure this, it’s important that our services are used in a reasonable and responsible manner.
This Fair Use Policy outlines the standards for acceptable use and is designed to:
- Protect the safety, rights, and experience of all users, as well as Iperium’s infrastructure, network and systems.
- Prevent misuse that could negatively impact service quality for other users.
- Prevent misuse that could negatively impact service quality for other users.
- Ensure compliance with our obligations to our network and wholesale partners.
We may act if services are used in a way that breaches this policy. Kindly take a moment to review the expectations and ensure a clear understanding of these expectations.
1. Overview
1.1 This Fair Use Policy (FUP) outlines the acceptable and responsible use of all services provided by Iperium Pty Ltd (ABN 42 130 547 643), including but not limited to internet, data, hosted infrastructure, voice, cloud, cybersecurity, and managed services (collectively, “Services”).
1.2 The purpose of this policy is to:
a) Protect the integrity, security, and performance of our infrastructure and services;
b) Ensure all users experience consistent service quality;
c) Prevent misuse, fraud, and exploitation of Iperium services;
d) Outlines the terms governing your use of our Services, including your responsibilities, acceptable use, and activities that are not permitted.
1.3 This policy forms part of your agreement with Iperium and should be read in conjunction with:
a) Your Service Application and relevant Service Schedules; and
b) The Standard Form of Agreement (SFOA); and
c) Pricing Schedules and other terms provided by Iperium; and
d) Any applicable laws and industry regulations.
1.4 Where there is any inconsistency between this document and any other agreement, this document will take precedence.
2. Application of Policy
2.1 This policy applies to all customers and users of Iperium’s Services, including those you permit to access or use your service.
2.2 You are responsible for ensuring that any user of your Iperium service complies with this policy.
3. Acceptable and Responsible Use
3.1 You must use the Services:
a) In accordance with applicable Australian law;
b) For lawful and authorised purposes only;
c) In a way that does not interfere with, impair, or degrade our network or the experience of other users.
3.2 You must not use, attempt to use, or permit others to use the Services:
a) For illegal activities, including but not limited to fraud, copyright infringement, or unauthorised access;
b) To transmit, store, or distribute offensive, defamatory, obscene, or unlawful material;
c) To harass, threaten or intimidate individuals or groups;
d) To access, probe, scan, or compromise other networks, systems, or devices without authorisation;
e) To disseminate viruses, malware, or any form of malicious software;
f) To perform any activity likely to cause harm to Iperium’s network, services, or reputation;
g) To host servers or operate services inconsistent with your service agreement without written consent.
3.3 You must not:
a) Use another user’s credentials, or attempt to gain unauthorised access to any account; and
b) Use Services in a manner that creates an undue burden on the network, including excessive bandwidth consumption or non-standard usage.
4. Spam and Unsolicited Communication
4.1 You must not use the Services in breach of the Spam Act 2003 (Cth).
4.2 Prohibited activity includes:
a) Sending or assisting in sending unsolicited commercial electronic messages (spam);
b) Using address-harvesting software;
c) Hosting systems that facilitate spam transmission or open relays;
d) Ignoring unsubscribe requests.
4.3 Iperium actively monitors for spam and reserves the right to suspend or terminate services that breach this section.
5. Excessive or Unreasonable Use
5.1 All Services must be used in line with your specific plan entitlements, including bandwidth, capacity, and usage limits.
5.2 Usage may be considered excessive or unreasonable where:
a) It materially exceeds standard residential or business usage patterns;
b) It causes network congestion, degradation, or impacts other users;
c) It involves non-standard activities (e.g., automated scraping, mass file transfers, etc.) not intended under your plan.
5.3 Iperium reserves the right to apply traffic shaping, service restrictions, or additional charges in cases of persistent excessive use.
6. Security Obligations
6.1 You are responsible for securing your devices, networks, accounts, and passwords.
6.2 We recommend you:
a) Use up-to-date antivirus, antimalware, and firewall protections;
b) Regularly update software and firmware;
c) Protect your Wi-Fi and local network with strong passwords;
d) Educate users in your organisation on safe usage practices.
6.3 Iperium is not liable for unauthorised access or usage caused by insufficient security on your part.
7. Copyright and Intellectual Property
7.1 You must not use the Services to copy, store, distribute or publish content that infringes copyright or other intellectual property rights.
7.2 Upon receiving a valid notice of alleged infringement, Iperium may remove the offending material or suspend your service without prior notice.
8. Content Responsibility
8.1 You are solely responsible for any content you access, create, store, share, or distribute via the Services.
8.2 If minors access the Services through your account, you must implement appropriate parental controls or filtering software.
8.3 Content that is illegal, offensive, or classified as ‘prohibited’ by the Australian Communications and Media Authority (ACMA) may be removed without notice.
8.4 Iperium will cooperate fully with law enforcement or regulatory requests, including disclosing account details or usage data when legally required.
9. Breach and Enforcement
9.1 Iperium may restrict, suspend, or terminate your Services if we believe there has been a breach of this FUP.
9.2 Where possible, you will be notified of the breach and given a reasonable time to remedy it. For serious or repeated breaches, Iperium may take immediate action without notice
9.3 In cases of service termination, you may be entitled to a pro-rata refund of prepaid fees, minus any costs incurred due to the breach.
